******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.24 dated 21.03.2017 registered for offences punishable under Sections 379-B read with Section 34 of Indian Penal Code (for short, "IPC") and 25 of the Arms Act, at Police Station Division No. 8, District Ludhiana. Heard.
As per case of prosecution, petitioner and his co-accused have snatched car bearing registration no. CH-01-AB-2525, currency notes of `4200/- and one mobile phone (I-phone 6) having SIM bearing no. 9779685539 inserted in it, from complainant-Sanjeev Kumar at pistol point in the area of Fountain Chowk, Ghumar Mandi road, Ludhiana. The snatched car was recovered from possession of the petitioner. Learned State counsel submits that the petitioner is involved in two other similar type of cases. CRM-M-15788 of 2017 -2upon prosecution witnesses and tamper with its evidence. Learned counsel for petitioner seeks bail for the petitioner on the ground of parity with his co-accused, who have been allowed bail in this case. However, I am of the opinion that parity is not attracted in this case as recovery of car snatched from complainant was made from the petitioner while from other co-acused, who have been arrested in this case, no recovery was effected.
