(ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of mandamus directing the respondents to regularize the services of the petitioner from 01.02.1996 as 'Beldar' (a class IV post), in accordance with the Instructions dated 07.03.1996 and 18.03.1996 (Annexures P-4 and P-5). 2.

Matter was taken up for hearing on 11.05.2022 when the petitioner was represented but learned State counsel sought time to get instructions. Subsequently, it was again taken up on 05.07.2022, when on a Court query to ascertain as to whether the petitioner's services at any stage were dispensed with during pendency of the writ proceedings or whether he was accorded the benefit of regularization as per the applicable policy which is the claim in the writ petition herein, learned State counsel sought time qua the same. 3.

On resumed hearing today, learned State counsel is unable to assist the Court for lack of instructions. As regards the petitioner, none represented him on the earlier date of hearing and same is the position today, though he was represented prior thereto.

It seems that by sheer effluxion of time and pendency of the writ petition for more than 22 years before this Court, it has been rendered infructuous and/or the petitioner seems to have lost interest in pursuing the same. 5.

Be that as it may, writ petition is disposed of with liberty to the petitioner to file an appropriate application in case, any cause of action still survives.
