ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 18.11.2022, when one appeared for the appellant and it was observed that learned counsel who earlier filed instant appeal quit practice and joined superior judicial services and later retired as Judge of Delhi High Court. Registry was asked to issue notice to appellant. Pursuant thereto, needful has been done.

Office report reveals that appellant has expired. Since legal heirs of appellant have not taken any steps to get themselves impleaded, it appears that they are not interested to pursue the appeal filed by their predecessor-in-interest.

In the premise, instant appeal is dismissed for nonprosecution with liberty to file application in case legal heirs wish to do so at a later stage.
