Through this petition under Section 439 Cr.P.C., petitionerAkash @ Angad, has prayed for grant of regular bail in case FIR No. 731 dated 04.08.2017 registered under Sections 148, 149, 302, 307 and 414 IPC; Section 25 and 29 of the Arms Act and Section 3. of the Scheduled Case and Scheduled Tribes (Prevention of Atrocities) Act, 1989 at Police Station City, Hisar.

According to the prosecution, allegations against the petitioner are that he sold a revolver which was used for committing murder of two persons, namely; Sachin and Sunil, to his co-accused, namely; Parveen Saini or Shankar, after stealing the same from the house of one Sanjay S/o Om Parkash Chopra resident of Fatehabad, around 2/21⁄2 months prior to the occurrence.

Leaned counsel for the petitioner inter alia contends that petitioner has falsely been implicated under Section 414 IPC. He has no involvement in the murder of Sachin and Sunil, aforesaid. Petitioner is in custody since 17.08.2017. Conclusion of trial may take long time. No useful purpose would be served by detaining the petitioner in jail. 4.

On the other hand, learned State counsel vehemently opposed the above submission of learned counsel for the petitioner. 5.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Akash @ Angad, is ordered to be released on bail pending trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
