Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.994 dated 24.09.2017 under Sections 148, 149, 324 and 307 IPC, registered at Police Station City Karnal. Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per prosecution version, present petitioner is named in the FIR and stated to be armed with knife and has given two blows in the abdomen of the complainant. CRM No.M-16692 of 2018 -2already been presented but till today, no PW has been examined. The case is at preliminary stage. There are chances of tampering with the evidence. Otherwise also, in view of the nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of regular bail at this stage.
Therefore, finding no merit in the present petition, the same is dismissed.
