The present regular second appeal has been filed against the judgment dated 18.03.1991 passed by learned Additional District Judge, Gurdaspur whereby the appeal filed against the judgment and decree dated 10.03.1989 is allowed.

Notice issued to the appellant has been received back with the report that appellant Nos.1, 3 and 5 have passed away and appellant No.2 was served through wife-Rampyari. However, there is no representation, despite the case having been called out twice. Respondent Nos.1 to 4 are reported to have passed away and respondent No. 5 is not residing at the given address 3.

Dismissed for non-prosecution.

Registry is directed to send a copy of this order to the appellant at the last known address, as also to the concerned SHO of the area to intimate the same. 5.

A period of three months is granted for seeking recalling of this order.
