LISA GILL, J. (Oral) The petitioner seeks the concession of anticipatory bail in FIR No.28 dated 16.05.2015 under Sections 323, 498-A IPC registered at Police Station Talwandi Chaudhrian, District Kapurthala. It is noticed that the matter was placed before the Mediation & Conciliation Centre of this Court and arrest of the petitioner was stayed. It was stated by respondent No.2 before this Court on 16.08.2017 that she had stayed with her husband for two days pursuant to mediation in a rented accommodation on an assurance by the husband/petitioner that he would take her to the matrimonial home thereafter. However the petitioner again abandoned her and the complainant now found out that she is pregnant. An affidavit dated 13.11.2017 to this effect was filed. On the last date of hearing none appeared on behalf of the petitioner. The matter was adjourned for today. The arguing counsel has not appeared again. Crl. Misc. No. M-15827 of 2017 [ 2 ] from the petitioner. It is apparent that the petitioner is trying to misuse the interim relief afforded to him.
As per the FIR marriage between the complainant and the petitioner was solemnized three years prior to the registration of the FIR. A son was born out of this wedlock. It is mentioned that till six months after the marriage the complainant was treated well but thereafter the demand for dowry was raised. Matter was compromised. At that time, the complainant was carrying a child and was pregnant by four months. The petitioner and other family members pressurized her to get the child aborted for which she did not agree. She was harassed for dowry and physically abuseddue to which she had to be admitted at the hospital. The matter was again compromised with the intervention of respectable persons and the complainant started living at her in-laws home again. However the matter did not end, the complainant was allegedly harassed again. It is stated that on 04.05.2015 she was subjected to severe physical abuse due to which she had to be hospitalized again. Specific allegations of physical abuse and demand of dowry are raised in the FIR even while the complainant was pregnant.
Keeping in view the allegations in the FIR and the subsequent conduct of the petitioner, no ground is made out for grant of concession of anticipatory bail to him Petition is accordingly dismissed.
