Prayer in the present petition under Section 482 Cr.P.C. is for seeking clarification as to whether the pendency of the anticipatory bail under Section 483 Cr.P.C. before the Hon'ble High Court creates embargo for filing of charge-sheet by Investigating Officer under Section 173 Cr.P.C. after completing investigation in FIR as the Investigating Officer in FIR No. 56/2018 under Sections 376, 37 of IPC dated 07.07.2018 at Police Station Women Faridabad is not filing the chargesheet after completing investigation since 2 years and 8 months of registration of FIR taking plea that the anticipatory bail of accused is pending before this Hon'ble Court since 20.08.2018 and for issuance of direction to the respondents No. 1 to 3 for filing of charge-sheet under Section 173 Cr.P.C. in time bound manner in the aforesaid FIR. CRM-M-13889-2021 -2 - Learned counsel for the State submits that the present petition has been rendered infructuous as challan in the present case has been filed on 20.08.2021. Thereafter, charges have been framed on 04.03.2022. Now the trial has commenced and 06 witnesses out of 20 witnesses have been examined and the next date fixed before the learned trial Court is 06.05.2024.
None appears on behalf of the petitioner today. In view of the submissions made by learned counsel for the State, the present petition is disposed of as having been rendered infructuous. In case anything survives in the present petition, liberty is granted to the petitioner to revive the same within a period of three months from today, if so advised.
