The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.138 dated 22.3.2016 registered for the offences under Sections 21-B and 27-A of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the NDPS Act') at Police Station City Fatehabad, District Fatehabad. Notice of motion has been issued in this case. Mr. Vikramjit Singh, learned Additional Advocate General, Haryana has put in appearance on behalf of respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Harpal Singh Parmar 2016.09.07 10:36 I attest to the accuracy and authenticity of this document Chandigarh

From the record, I find that as per the FIR two co-adccused of the present petitioner have been apprehended and the petitioner fled away from the spot. The recovery from the car is stated to be plastic bags etc. containing 345 bottles of Rexcof make Cipla.

Keeping in view the recovery being commercial quantity and the petitioner being nominated in the present case, I do not find it a fit case where the petitioner is entitled to the benefit of anticipatory bail. Otherwise also, the petitioner is required for custodial interrogation. Therefore, from the above, I do not find any merit in this petition and the same is dismissed.
