M.M.S. BEDI, J. (ORAL) Petitioner along with his family members is an accused in a criminal case of assault which was originally registered, inter alia, under Section 307 IPC. The FIR was registered at the instance of Suresh Singh.

The grievance of the petitioner is that a criminal case has been registered as a counterblast to the complaint filed by the petitioner in which summoning order Annexure P2, has been passed as the complainant party has mercilessly given beatings to the petitioner but the local police had not registered the FIR. The petitioner claims that he has been falsely implicated in the FIR. Through the instant petition under Section 482 Cr.P.C., the petitioner has sought for a fair investigation of the matter by an independent agency.

CRM-M-15776-2015 (O&M) investigation appears to be not maintainable especially when the petitioner seems to have not submitted any representation indicating his grievance to any higher police authority. No such application has been appended with the petition. On 3.8.2015, counsel for the petitioner had made a request to place on record copy of representation filed by the petitioner. No representation has been placed on record till date.

In view of above said circumstances, this petition is disposed of as not maintainable with liberty to the petitioner to express his grievance, if any, regarding the investigation against the statutory rules and regulations, to the higher police authorities at the first instance. In case the grievance still subsists, it will be open to the petitioner to approach this Court again.
