**** SHEKHER DHAWAN Present petition for release of petitioner Pawan @ Pona on regular bail in FIR No.364 dated 24.08.2014, under Sections 307 and 341 read with Section 34 IPC and Section 25 of the Arms Act. 2.

Notice of the petition was issued to the respondent-State. 3.

Having considered the submissions made by learned counsel for the parties, the fact is not disputed that petitioner was not named in the FIR. He has not been attributed any specific role or was accompanying with main accused Kuldeep.

Learned counsel for petitioner urged that main witness Rahul was examined but he has not supported the case of prosecution. Petitioner is in custody since 26.08.2014. Crl. Misc. No. M-15781 of 2015 (O&M) -2- (main accused). Co-accused Anil @ Raghu has already been released on regular bail in case CRM-M No.3036 of 2015, vide order dated 04.02.2015 by this Court and the case of present petitioner is on the same footing. No recovery has been effected from the petitioner. 5.

In view of above facts, present petitioner Pawan @ Pona is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate. Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
