(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 278, dated 21.10.2014, registered at Police Station City Kapurthala, District Kapurthala, who has been booked for having committed the offence punishable under Sections 420/465/467/468/471/120-B IPC.
F.I.R has been registered against Gurdip Singh and 18 others including the present petitioner on the basis of some letters written by the Regional Passport Officer, Jalandhar wherein it was alleged that the accused had applied for the passport to their office accompanied by birth certificates which were found to be fake.
The allegation against the present petitioner is that he has prepared forged birth certificate of Gurjit Singh and the petitioner was arrested on 25.11.2014 on the disclosure statement of Gurjit Singh wherein he alleged that he had procured fake birth certificate from the present petitioner by GAURAV 2015.02.06 16:19 I attest to the accuracy and integrity of this document
Crl. Misc. No. M-1579 of 2015 (O&M) -2paying him Rs.5,000/- Learned State counsel on instructions from ASI Pawan Kumar submits that the petitioner is no longer required for further interrogation.
The petitioner is in custody since 25.11.2014 I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.
Keeping in view the period of incarceration of the petitioner, this court feels that there is no need to detain the petitioner any longer, Accordingly, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to their furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kapurthala.
