Rajan Gupta, J (Oral) Learned State counsel submits that present petition under Section 340 Cr.P.C is not maintainable. Infact enquiry has been conducted by respondent No.3. It has been found that respondent No.4 has contracted second marriage. However, no case could be registered, offence being non-cognizable in nature. I find merit in the stand of learned State counsel. No further adjudication of the matter is necessary. Petitioner is at liberty to avail remedy available to her under the law. Dismissed.
