**** MANJARI NEHRU KAUL, J. (Oral) The instant petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail, in case FIR No.10, dated 27.03.2019, under Sections 498-A, 323 IPC, registered at Police Station Women Cell, District Bathinda.
Learned counsel for the petitioner inter alia contends that a perusal of the allegations levelled in the FIR in question reveals that not only the allegations are vague and general in nature, even the mischief of Sections 498-A, 323 of IPC are not attracted in the instant case. It was submitted that it is the wife of the petitioner, who would pickup quarrels with the petitioner and indulge in unruly and uncalled for behaviour. Many a times, the petitioner tried to adjust with his wife and also tried to amicably settle the matter by way of a compromise, however, it proved to be of no avail, as his wife would continuously misbehave with him. Heard and perused the FIR as well as other material on record. A perusal of the allegations levelled in the FIR reveals that serious allegations have been levelled against the petitioner qua the demand of dowry and ill-treatment of his wife including physical assault, for which JAWALA RAM 2020.03.19 14:19 I attest to the accuracy and authenticity of this document Chandigarh his wife had to be medically treated as well.
CRM-M-9709-2020 - 2 - Keeping in view the nature of serious allegations levelled against the petitioner no ground for grant of anticipatory bail is made out. Dismissed. However, it is made clear that anything observed herein shall not be construed as an expression of opinion on the merits of the case.
