The petitioners are accused in FIR No.92 dated 30.04.2019 for the offence punishable under Sections 406, 420 and 120-B of IPC, 1860 registered at Police Station Kharar, District SAS Nagar. By way of this petition filed under Section 528 BNSS, 2023, the petitioners seek quashing of the said FIR. The basis for seeking this relief is the compromise deed dated 06.08.2021 (Annexure P-2), whereby they claim to have settled their differences with complainant/respondent No.2.

On the asking of the Court, Ms. Ankita Ahuja, Advocate accepts notice on behalf of the respondent-State.

Mr. Fateh Sahota, Advocate has put in appearance and accepts notice on behalf of respondent No.2. He confirms the factum of the compromise having been effected between the parties and states that respondent No.2 has no objection to the quashing of the FIR in question.

Learned State counsel states that no other FIR has been registered against the petitioner and he has no known criminal antecedents. 6.
In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 7.
Accordingly, the petition is allowed and FIR No.92 dated 30.04.2019 for the offence punishable under Sections 406, 420 and 120-B of IPC, 1860 registered at Police Station Kharar, District SAS Nagar, and all other consequential proceedings arising therefrom shall stand quashed.
