CRM-M-15809-2015 Date of decision: 14.05.2015 Manjit Kaur ..... Petitioner

Versus

State of Punjab and others ..... Respondents

CORAM:

HON'BLE MR. JUSTICE R.P. NAGRATH PRESENT: Mr. Hemen Aggarwal, Advocate for the petitioner. R.P. NAGRATH, J. (ORAL) Prayer in the instant petition filed under Section 482 Cr.P.C. is for issuance of a direction to respondents No. 1 to 5 to remove the illegal encroachment/possession of respondent Nos. 6 to 9 on the Panchayat Land comprised in Khasra Nos. 161 and 162. It is the contention of learned counsel for the petitioner that despite repeated directions by all the concerned authorities, the possession has not been delivered.

After hearing learned counsel for the petitioner, I am of the considered opinion that such a course for seeking direction under Section 482 Cr.P.C. in the facts and circumstances of the instant case cannot be adopted. The instant petition stands disposed of with liberty to the petitioner to seek appropriate remedy, in accordance with law. May 14, 2015 ( R.P. NAGRATH ) rishu JUDGE RISHU KATARIA 2015.05.14 17:41 I attest to the accuracy and authenticity of this document
