The present petition has been filed under Section 482 of the Code of Criminal Procedure for quashing of criminal complaint No.COMI/8/19 dated 22.01.2019, Annexure P-1 filed under Sections 307, 323, 324, 326, 336, 427, 148, 149, 506 IPC and Sections 25, 27 Arms Act, 1959, at Police Station Sarai Amanat Khan, District Tarn Taran as well as summoning order dated 21.11.2022. 2.

After arguing for some time, learned counsel for the petitioners prays for withdrawal of the instant petition with liberty to raise all pleas before the trial Court at the appropriate stage. He however, prays that the trial Court be directed to grant exemption to petitioner No.1, he being 75 year old and suffering from various age related ailments. He will also furnish an undertaking by way of affidavit to appear before the trial Court on the dates, for which his presence is absolutely necessary.

Dismissed as withdrawn with liberty aforesaid. 4.

In case petitioner No.1 files an application for grant of exemption from personal appearance, the trial Court shall sympathetically consider the same keeping in view the aforesaid facts.
