Mr.Kuldip Tiwari,Addl.AG Haryana assisted by HC Pardeep Kumar Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail on behalf of accused petitioner-Daler Singh in FIR No.323 dated 24.7.2014 under Section 379 IPC, PS Sector 5, Panchkula.

On 24.7.2014 a Zen car belonging to complainant-Ankit Sharma was stolen from Panchkula. On the arrest of co-accused Upkardeep @ Prince in August 2015 in a separate FIR, and on his disclosure statement the name of the petitioner accused has surfaced in the present FIR and the recovery of stolen car with forged chasis/engine number has been recovered.

Learned State counsel on instructions submits that offences under Sections 420,467,468,471,120-B IPC have since been added and prayer in the present petition is only for offence under Section 379 IPC. At this stage,learned counsel for the petitioners seeks withdrawal of the present petition with liberty to file a fresh one by including subsequently added sections.
