Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case bearing complaint No.32010 dated 24.12.2012 under Sections 420, 406 and 120-B IPC wherein the petitioner has been summoned to face trial vide order dated 06.08.2016. I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the present petitioner has been summoned in a complaint case. She applied for anticipatory bail before the Court of learned Sessions Judge and vide order dated 16.12.2016, the bail application was accepted and the petitioner was directed to appear before the trial Court within 10 days positively and on her doing so, it was ordered that she shall be admitted to bail on furnishing personal bonds but the Vineet Gulati 2017.05.09 16:32 I attest to the accuracy and authenticity of this document Chandigarh petitioner did not appear before the trial Court as was the condition while

CRM No.M-15903 of 2017 -2accepting the anticipatory bail by the Court of Session. Again, on 15.03.2017, second bail application was filed before the Court of Session, which was dismissed on 29.03.2017 as during the above-said period, the petitioner was declared proclaimed offender on 07.03.2017. Keeping in view the above fact that the petitioner has not complied with the order of Court of Session and has not surrendered before the trial Court and in view of the fact that the petitioner was declared proclaimed offender, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.

Therefore, finding no merit in the present petition, the same is dismissed.
