The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in criminal complaint No.114 dated 31.7.2007 filed for the offences under Sections 302, 323, 148 and 149 IPC, pending in the Court of learned Judicial Magistrate Ist Class, Phagwara. Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. Shaurya Puri, learned Advocate appearing for Mr. P.S. Ahluwalia, Advocate has appeared for the complainant and contested this petition. I have heard learned counsel for the parties and learned Assistant Advocate General, Punjab appearing for the respondent-State and Harpal Singh Parmar 2017.05.31 15:58 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-15905 of 2017 [2] have gone through the record.

The petitioner has been summoned in a complaint case under Section 302 IPC. She was not stated to be armed with any weapon. No injury is attributed to her. Only push blow is stated to have been attributed to the petitioner. She is not required for investigation or interrogation purposes as it is a complaint case. She is only to face the trial it being a complaint case. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case and in view of the fact that the petitioner has already surrendered before the trial Court and has been released on interim bail; I find merit in this petition and the same is allowed. The interim order dated 8.5.2017 passed by this Court granting interim bail to the petitioner is made absolute. May 30, 2017.
