The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.21 dated 31.3.2018 registered for the offence under Section 420 IPC at Police Station Jhulka, District Patiala.

Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has appeared on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the FIR the allegation against the present petitioner is that he had taken `3,10,000/- from the complainant Harpal Singh Parmar 2018.08.08 16:57 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-16789 of 2018 [2] for sending complainant's daughter to foreign country and to provide her a job of Nurse. As per the allegation, Visa was only for three months and the daughter of the complainant was given the job of cleaning the toilets in some Mall.

Keeping in view the facts and circumstances of the present case and in view of the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where he is entitled for the grant of anticipatory bail. Further more, the petitioner while on interim bail was directed to surrender his passport or to file an affidavit that he has no passport, but neither he surrendered the passport nor filed any affidavit, which shows that he has not complied with the order dated 23.42018 passed by this Court.

Therefore, finding no merit in this petition, the same is dismissed.
