FAOs-1895, 4506, 3235 & 3236-2003 2026:PHHC:057965 DEEPAK GUPTA, J. (ORAL) It is a set of four appeals arising out of the same motor vehicular accident. Two appeals [FAOs-1895 & 4506-2003] have been filed by the claimants and two appeals [FAOs-3235& 3236-2003] have been by the driver and owner of the offending vehicle.

Learned counsel for the respondents No.1 & 2 of FAO-1895-2003 and FAO-4506-2003, which were filed by the claimants, has placed on record copy of statement, which was made by the claimants before learned MACT, Kaithal to the effect that matter had been compromised; nothing was due and that they shall withdraw their respective appeals pending before the High Court.

Counsels for the appellants-claimants (in FAOs-4506 and 1895-2003, are not in a position to refute the aforesaid statements. 4.

In view of theabove, both these appeals [FAOs-1895 & 4506-2003] are disposed of having been already compromised before learned MACT, Kaithal.

As far as FAOs-3235 & 3236-2003, are concerned, these are filed by the driver and owner of the offending vehicle. Learned counsel appearing on behalf of the appellants of these appeals have made a statement for withdrawing these appeals.

In view of above, FAOs-3235 & 3236-2003 stand disposed of having been withdrawn.

Accordingly, all the four appeals are hereby disposed of. A photocopy of this order be placed on the file of connected cases.
