The petitioners seek the concession of pre-arrest bail in a case registered at the instance of Satinder Singh alleging that on 28.3.2016 while he was on way back to his house, Gurpreet Singh way laid the complainant by his tractor. Thereafter, Gurpreet Singh followed the complainant and after parking his tractor, attacked the complainant with a sword by bringing Amar Singh and Gian Singh, petitioners. The petitioners caught hold of the complainant while Gurpreet Singh gave a sword blow on the head of the complainant, on account of which he fell down. Thereafter, the petitioners gave kick blows to him and escaped from the spot. So far as the petitioners are concerned, they had merely caught hold of the complainant whereas Gurpreet Singh is alleged to have inflicted a sword blow on the person of the complainant.

Counsel for the petitioners has vehemently contended that the petitioners and the complainant are neighbours and that the petitioners have been falsely implicated in the case on account of previous enmity. With the assistance of counsel for the parties, I have gone through the police file. As the petitioners have joined the investigation and

Cr. Misc. M 16835 of 2016 have not been attributed any specific injury, they can be granted the concession of pre-arrest bail.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that they will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
