Present:
Mr. Aman Bansal, Advocate for the appellants. Mr. Rajbir Singh, Advocate for the Insurance Company. ***** In this case, the respondent-Insurance Company was exonerated from the liability to pay the compensation.
However, as agreed, as per statements of learned counsel for the appellants, learned counsel and representative of the respondentInsurance Company (separately recorded), a sum of Rs.9,50,000/- (Nine lakh and fifty thousand only) over and above the amount awarded by the Tribunal is allowed to the appellants in full and final settlement of the claim in this appeal.
During Lok Adalat, while arriving at a settlement, the interest of all the parties especially the minors is paramount. Accordingly, we dispose of this case with a direction to the Insurance Company to deposit a crossed-cheque for Rs.2,37,500/- in the name of appellant No.1-Shehnaj and a crossed-cheque for Rs.2,37,500/- in the name of appellant No.4-Shakura Begam with the office of Lok Adalat of the High Court within a period of two months in compliance of this order, failing which, interest @ 9% per annum shall follow on this amount from the date of this order till payment. The remaining amount i.e. Rs. 4,75,000/- in equal shares be deposited in the shape of two separate FDRs, in the names of appellant Nos.2 and 3 (Minors), which shall be payable to them on their attaining majority.

FAO-2267-2019 (O&M) -2The concerned Officer of the Lok Adalat Branch/Office shall issue proper receipt after receiving the cheques to learned counsel/representative of the respondent-Insurance Company. The appellant(s)' counsel/appellant(s) may collect the cheques from the office of the Lok Adalat.
Copy of the order be supplied/sent to the counsel/parties and file be returned to the Hon'ble High Court.
