**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through video conferencing.

Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.219 dated 28.07.2019 registered under Section 420 IPC, at Police Station Bhawanigarh, District Sangrur.

Notice of motion was issued on 03.03.2020 to the following effect:- "Learned counsel for the petitioner submits that an amount of Rs.3,00,000/- was deposited in the year 2015 i.e. Prior to registration of FIR in question and an amount of Rs.3,78,000/- was deposited after the registration of the FIR. Out of total Rs.7,00,000/-, the petitioner has deposited an amount of Rs.6,78,000/- and is still ready to settle the account with the bank.

Notice of motion for 30.04.2020.

CRM-M-9440-2020 before the SHO/Investigating Officer to join investigation on 07.03.2020 at 11.00 a.m. and in the event of his arrest, he shall be enlarged on ad interim bail, subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of Arresting Officer. However, petitioner shall abide by the conditions as envisaged under Section 438(2) Cr.P.C."

Learned counsel for the petitioner submits that the petitioner has already deposited the entire amount with the bank and even a compromise has been effected. The civil suit for recovery filed by the Bank stands already withdrawn. Learned State counsel on instructions from ASI Sukhpal Singh admits the aforesaid fact and submits that the petitioner has joined the investigation to the entire satisfaction of the investigation Officer but he pleads no instructions qua the factum of compromise.

Be that as it may, since the petitioner has joined the investigation to the satisfaction of the Investigating Officer, therefore order dated 03.03.2020 is made absolute. Petitioner shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

Petition stands disposed of.
