Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail to the petitionerRajwinder Kaur in case FIR No.72 dated 15.3.2016 for offences punishable under Sections 307,326,323,452,34 and 120-B IPC,PS A Division, District Amritsar City.
The complainant Jagjit Singh @ Raju is the real brother of the petitioner-accused.
As per the allegations at 6.45 pm on 10.3.2016 three unknown young men came on a motor cycle to the shop of the complainant and inflicted injuries with datar/sticks.
The injured complainant has suffered four injuries including one on the head, one on the ear and two on the left hand/palm. The name of the petitioner-accused has surfaced as the principal conspirator at whose instance the injuries have been inflicted. It was contended that the complainant is a notorious person,who had been disinherited by the parents and the entire property was bestowed upon the accused-petitioner due to the said reason, false allegations are being levelled against the petitioner. At the time of hearing today, learned counsel for the petitioner submits that in terms of the order dated 16.5.2016 petitioner has joined investigation and fully cooperated.
Learned State counsel on instructions states that petitioner has joined investigation and her custodial interrogation is no longer required whereas learned counsel for the complainant vehemently opposes the grant of bail.
After hearing the learned counsel and keeping in view the stand of the learned State counsel, interim bail/protection granted vide order dated 16.5.2016 is made absolute.
