ARUN PALLI, J (Oral) On January 17, 2023, this Court had passed the following order: "Learned counsel for the petitioner seeks time to file the replication to clarify that before 2020 when he was purchasing this unmanufactured tobacco, it was being assessed for sales tax purposes in Delhi and there is no objection raised by the authorities in Delhi.

List this matter on 23.3.2023."

Office report indicates that replication has not been filed. None has appeared either on behalf of the petitioner to pursue the matter. That being so, this court is choice-less but to dismiss the petition for non prosecution.

Dismissed for non prosecution.
