Notice of motion has been issued. Mr. A.S.Dhaliwal, Deputy Advocate General, Punjab, has put in appearance on behalf of the respondent-State and contested the instant petition. I have heard learned counsel for the petitioner as well as learned State counsel and gone through the record. From the record, I find that vide order dated 27.10.2016 (Annexure P-7), passed by this Court in CRM No.M-33531 of 2016, the earlier petition filed by the petitioner was dismissed and it was directed that in case the prosecution does not lead its entire evidence on or before 25.01.2017, (subject to the accused not obstructing the same), the petitioner Rajesh Kumar 2017.08.16 16:29 I attest to the accuracy and authenticity of this document Chandigarh

 be released on bail to the satisfaction of the trial Court. Admittedly, the petitioner had not filed any application for bail before the learned trial Court and it is also admitting during the course of arguments that the prosecution has already closed its evidence.

In view of above, the present petitioner is not entitled to grant the benefit of regular bail.

Therefore, finding no merit in the instant petition, the same is dismissed.
