Plaintiff-appellant is in appeal against the judgment and decree as modified by the lower Appellate Court in a suit filed for declaration and joint possession.

Learned counsel for the appellant submits that he has received instructions that appellant has died and he has tried his best to establish contact with the LRs but they are not coming forward. He submits that contesting respondent was only respondent No.1 who has also passed away. 3.

As per office report, respondent Nos.1 to 5 have died. Respondent No.6 was served, however there is no representation on his behalf. 4.

Dismissed for non-prosecution.
