******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.41 dated 14.04.2017 registered for the offence punishable under Section 61 of Punjab Excise Act, at Police Station City Sunam District Sangrur.

Heard.

As per case of prosecution, 44 bottles of countrymade liquor marka "Mota Santra" was recovered from car bearing No.PB-13AR-8970 and the petitioner on witnessing the police party slipped away. The matter is still under investigation and identity of the petitioner is to be established.

CRM-M-15985-2017 -2opinion on the merits of the case, this petition is allowed and the petitioner is directed to surrender before the police and join investigation within two weeks. In the event of his arrest being required, he shall be released on anticipatory bail, subject to his furnishing bonds to the satisfaction of Arresting Officer. However, he shall abide by the terms and conditions as envisaged under Section 438(2)(i) to (iv) Cr.P.C. failing which he shall loose the benefit of bail allowed to him. In the event of petitioner committing default in joining the investigation within two weeks, he will not be entitled to benefit of anticipatory bail allowed to him.
