The present regular second appeal has been filed against the judgment dated 24.08.1990 passed by learned Additional District Judge, Jalandhar whereby the appeal filed against the judgment and decree dated 24.01.1989 is dismissed.

As per the last order, learned counsel, who had represented the appellant has since passed away and notice of actual date was issued to the appellant and as per office report, the GPA through whom the present appeal was filed is also no more. Notice issued to the appellant has also been received back with remarks 'not residing at the given address'. 3.

Dismissed for non-prosecution.

Registry is directed to send a copy of this order to the appellant at the last known address, as also to the concerned SHO of the area to intimate the same. 5.

A period of three months is granted for seeking recalling of this order.
