ALKA SARIN, J. (ORAL) The present appeal was filed in the year 1991 wherein the following address of the appellant was given : "Village Changali Qadim Tehsil Ferozepore now r/o village Rampur District Shahjahanpur (UP)."

On 01.05.2017 the following order was passed : "Since learned counsel for the appellant has passed away and there is no representation on behalf of the appellant, office is directed to issue actual date notice to the appellant for 25.09.2017."

Thereafter, notice was issued to the appellant, however, the same was received back unserved as the address given was incomplete. The address in the memo of parties is the same as the address before the Trial YOGESH SHARMA 2023.01.13 10:09 I attest to the accuracy and integrity of this order/judgment.

In view of the above and keeping in view the fact that none has come forward to pursue the case on behalf of the appellant, this Court is left with no other option but to dismiss the present appeal for non-prosecution.
