(Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.115 dated 19.06.2024 under Sections 61/1/14 of the Excise Act, 1914, registered at Police Station Ajnala, District Amritsar (Rural). 2.
Learned counsel for the petitioner contends that the petitioner has been named as an accused in the aforementioned FIR. He further submits that nothing is to be recovered from the petitioner as alleged recovery has already been effected.

This Court, vide order dated 27.02.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

Learned State counsel states that the petitioner has joined the investigation and is not required for custodial interrogation. 5.

CRM-M-10322-2025 -2especially when the petitioner having joined investigation, the order dated 27.02.2025 granting interim bail to the petitioner is made absolute. 6.
However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
