Mr.Kirat Singh Sidhu,DAG Punjab assisted by ASI Resham Singh Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail in complaint case bearing No.122/2014 dated 1.5.2014 titled as Rajinder Kumar v Balbir Singh and another, under Section 3(ii) and 3(x) of SC/ST Act pending in the Court of learned SDJM,Kalka wherein petitioner has been summoned under Section 3(1)(x) of the aforesaid Act.

Petitioner is working as a Duty Incharge at Sub-Depot, Haryana Roadways, Kalka wherein complainant Rajinder Kumar is working as a Driver. On the complaint made by the petitioner against complainantDriver for negligence of duty he was placed under suspension on two occasions and thus he was nursing a grudge against the petitioner. It was contended that false allegations have been levelled by the complainant after one year of the occurrence on 27.3.2013. Petitioner was not on duty on the day of alleged occurrence. That apart, it was submitted that co-accused Surjeet Singh had been granted benefit of preRAJINDER PRASHAD JOSHI 2016.05.28 11:20 I attest to the accuracy and integrity of this document

Vide order dated 17.5.2016 while issuing notice of motion it was directed that in the event of surrendering before the trial court within 7 days, petitioner be released on interim bail. At the time of hearing today,learned counsel states that in compliance of the said order, petitioner surrendered before the trial court on 21.5.2016 and was released on interim bail.

Learned State counsel on instructions is unable to refute the said factual position.

In view of the above interim bail dated 21.5.2016 granted by the trial court, pursuant to the order dated 17.5.2016, is made absolute. Disposed of.
