Learned counsel for the petitioners submits that petitioner No.2Jaswant Singh has died. He states that the order was passed by petitioner No.1, in his official capacity against which appeal filed came to be dismissed and no sanction was granted against him by the Department. The challan has not been presented against him, while all the co-accused stand acquitted vide judgment dated 20.03.2023, passed by the Ld. Additional Sessions Judge, Moga. 2.
Learned State counsel, on instructions, submits that the aforesaid fact shall be taken note of while inquiring into the matter, in view of which, learned counsel for the petitioners does not press the present petition, at this stage, reserving liberty to revive the present petition, in case need arises. 3.
Ordered accordingly.
