(ORAL) Prayer in the present petition is for modification/setting aside of judgment dated 30.11.2021 passed by the learned Additional Sessions Judge, Patiala, dismissing the appeal filed by the petitioner against the judgment of acquittal dated 25.01.2018 passed by the learned Judicial Magistrate 1st Class, Nabha, District Patiala; AND for modification/setting aside of judgment dated 25.01.2018 passed by the learned Judicial Magistrate 1st Class, Nabha, District Patiala whereby the accused/respondents No. 1 to 3 herein have been convicted and sentenced to undergo simple imprisonment for a period of one year each under Section 323 IPC; to undergo simple imprisonment for a period of one year each under Section 324 IPC; and acquitted under Sections 354 and 506 IPC in complaint No. COMI/567/2013 titled as Harbans Kaur vs. Sohan Singh filed under Sections 323, 324, 352, 354, 506, 34 of IPC, 1860.

    Perusal of the order sheets shows that notice of motion has not yet been issued in the present case. The petitioner has gone unrepresented on the last two dates of hearing i.e. 22.07.2022 and 23.08.2023. Even, today also for the third time, the petitioner has gone un-represented. Therefore, it can safely be presumed that the petitioner or her counsel is not interested in pursuing the present petition. In view of the above, the present petition is dismissed for non-prosecution.
