(ORAL) The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent No. 2 to re-issue him passport with correct date of birth.

Learned counsel for the petitioner inter alia contends that in the passport, date of birth of the petitioner was recorded as 01.01.1980 whereas his correct date of birth is 10.12.1973. He again applied for passport with correct date of birth. He appeared before passport authority on 06.11.2023 and pointed out this fact to authorities, however, till date passport has not been issued to him.

Ms. Shreyansi Verma submits that file of the petitioner has already been closed and petitioner is at liberty to file fresh application which would be decided, in accordance with law.

In the wake of statement of counsel for Union of India, counsel for the petitioner states that the present petition may be disposed of as not pressed, however, liberty may be granted to petitioner to approach competent authority.
