Mr. Narinder S Lucky, Advocate for the petitioner. HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail to the petitioner in Complaint No.3413 dated 27.08.2012 filed under Section 138 of the Negotiable Instruments Act, 1881 by respondent No.2. The petitioner was convicted by the trial Court vide judgment and order dated 03.10.2016 and sentenced to undergo RI for one year. The petitioner filed an appeal. For failure of the petitioner to appear before the learned Appellate Court, his bail bonds and surety bonds were ordered to be cancelled and his presence was ordered to be secured through non-bailable warrants.
Learned counsel for the petitioner states that the nonappearance of the petitioner was not intentional. It was due to the fact that the husband of the petitioner was seriously unwell and in fact, he even passed away on 18.1.2019. He undertakes that the petitioner shall appear before the learned Appellate Court on any date to be fixed by this Court. Notice of motion.

CRM-M-9780 of 2019 #2# Ms. Sunint Kaur, AAG, Punjab, who is present in Court, accepts notice on behalf of the respondent-State. Having heard learned counsel for the parties and taking into account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned Appellate Court on 30.3.2019. On her doing so, she shall be released on interim bail by the Appellate Court subject to her furnishing bail bonds and surety bonds to its satisfaction. She shall also file an undertaking before the Appellate Court to continue appearing before the Appellate Court as and when required apart from following all the terms and conditions fixed in this respect.
