    $     Section 438 of the Code of Criminal Procedure, 1973 (for brevity, 'Cr.P.C.') for grant of anticipatory bail in case FIR No.246, dated 20.12.2016, registered at Police Station Babain, District Kurukshetra, under Sections 148, 307, 323, 427, 452 and 506 of Indian Penal Code. Notice of motion was issued in this case. Learned State counsel put in appearance on behalf of the respondent-State and Mr. Parveen Chauhan, Advocate has put in appearance on behalf of the complainant and contested this petition.

 From the record, I find that the present petitioner is stated to be armed with sickle and simple injury on the left thumb of Maya Ram has been attributed to him. He has also given another injury to the complainant on his left arm, which has also been declared simple one. The main accused has already been granted the benefit of anticipatory bail. The challan has already been presented against other accused and the present petitioner has not been challaned.

Keeping in view the facts and circumstances of the present case; without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find that no useful purpose will be served by sending the petitioner to custody. Therefore, finding merit in the petition, the same is allowed and it is ordered that
