**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through video-conferencing.
Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.28 dated 15.01.2020 registered under Sections 419, 420 IPC at Police Station Dabua, District Faridabad.
On 03.03.2020, following order was passed:- "Learned counsel for the petitioner states that FIR in the present case has been lodged on false and frivolous ground and no other
-2case is pending against the petitioner.
Notice of motion for 22.05.2020.
Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to her furnishing personal bonds/surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C.

Learned State counsel on instructions from SI Rajesh Kumar submits that at one point of time, petitioner was summoned by the Investigating Officer, but she did not appear. In the investigation conducted by the police, the police did not find any incriminating material against the petitioner and filed challan against husband of the petitioner and 08 other coaccused. Petitioner has not been arrayed as an accused in the challan. Presence of the petitioner is not required in any manner.
In view of statement made by learned State counsel, this petition is rendered infructuous as the petitioner is not an accused in the FIR in question.
