Mr.Kuldip Tiwari,Addl.AG Haryana assisted by ASI Sher Singh Jaswant Singh,J(Oral) Prayer is for grant of regular bail to accused-petitioner Ajit Singh in case FIR No.427 dated 8.10.2015 under Sections 406,420,409 and 120-B IPC, PS Indri,District Karnal.
A resident of village-Bhupinder Singh-complainant alleges that petitioner during his tenure as Sarpanch for the period from 2010 to 2015 has misappropriated panchayat funds to the tune of Rs.1,65,595/- while executing various works.
It is contended that in two inquiries (P-2 and P-4) conducted by the police as also by the officials of Panchayat Department the petitioner was found innocent. It is further submitted that the petitioner is in custody since 19.4.2016 and investigations qua him are over. Learned State counsel on instructions does not dispute the custody period as also the fact that investigation qua petitioner is over. Without commenting on the merits of the case, keeping in view the custody period and the fact that trial is not likely to be completed in near future, petitioner is directed to be released on bail to the satisfaction of CJM/Duty Magistrate concerned.
