 Through this petition, the petitioner seeks anticipatory bail in case bearing FIR No. 09 dated 13.03.2020, registered under Sections 406 and 420 IPC, at Police Station NRI, District SAS Nagar. Vide order dated 27.09.2021 passed by a Coordinate Bench, the parties were relegated to the Mediation and Conciliation of this Court to settle the dispute amicably and for such facilitation, the arrest of the petitioner was also stayed. As per the compromise effected between the parties in the Mediation Centre on 31.01.2022, the petitioner is to pay Rs. 51 lakh to the complainant in four installments, commencing from 05.04.2022 and the last installment is to be paid on 05.08.2022. Learned counsel appearing for the complainant does not dispute the factum of compromise and prays to direct the petitioner not to leave the Country till the due amount is cleared.    I have heard the learned counsel for the parties. In view the facts and circumstances of the present case and without expressing any opinion on the merits of the case, this Court finds merit in this petition and the same is allowed. The petitioner is directed to join the investigation as and when called upon to do so and if he is sought to be arrested, he shall be released on anticipatory bail to the satisfaction of Investigating Officer/Arresting Officer, subject to the conditions as envisaged in Section 438 (2) of the Code of Criminal Procedure. The petitioner is also directed not to leave the Country uptil the last installment is paid.

It is made clear that if pursuant to and in compliance with this order, the petitioner does not cooperate with the investigating agency, the investigating agency would be liberty to move an appropriate application for cancellation of bail.
