This is a petition filed under Section 482 Cr.P.C for quashing of FIR No.40 dated 28.07.2011 registered under Sections 420, 467, 468, 471 IPC read with Section 21D and 21E of Forward Contracts Act at Police Station Daresi, Ludhiana.
Learned State Counsel has referred to the affidavit dated 30.01.2019 of ASI Janak Raj in which it has been specially mentioned that a cancellation report was filed before the learned Magistrate on 16.08.2016 but the complainant did not agree with the same as a result of which learned Magistrate vide order dated 21.11.2016 directed to conduct re-investigation in the matter and after re-investigation, since no offence was found to have been committed, thus, another cancellation report has been submitted and presented before the Magistrate on 10.01.2019 and the said matter is pending before the Judicial Magistrate Ist Class, Ludhiana. Learned State Counsel has further submitted that the case is now fixed for 09.03.2022 and, therefore, the present petition has been rendered infructuous. Keeping in view the above facts and circumstances of the case and noticing the fact that the cancellation report has been submitted before the Magistrate on 10.01.2019 and the case is pending for 09.03.2022 before the Judicial Magistrate Ist Class, Ludhiana, this Court is of the opinion that the present petition has been rendered infrcutuous and is disposed of accordingly.
