This order will dispose of above mentioned two petitions filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.103 dated 18.9.2015 (Annexure-P.1) registered for the offences under Sections 307,

Cr. Misc. Nos.M-17050 of 2016 etc.

[2] 325, 323, 148 and 149 IPC at Police Station Jaitu/Jaito, District Faridkot. Learned counsel for the petitioners prays that petitioner No.3Preet Singh alias Ganna in Criminal Misc. No.M-17050 of 2016 may be allowed to withdraw this petition. Prayer of the learned counsel for the petitioners is accepted and petition i.e. Criminal Misc. No.M-17050 of 2016 qua petitioner No.3-Preet Singh alias Ganna is dismissed as withdrawn. Notice of motion to Advocate General, Punjab. Ms. Shivali, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested these petitions.

I have heard learned counsel for the petitioners as well as learned Assistant Advocate General, Punjab appearing for the respondentState and have gone through the record. As per the prosecution version, injury dangerous to life has been given by Preet Singh alias Ganna/non-petitioner. Baljit Singh alias Shanti and Bagga Singh alias Bittu were stated to be armed with iron pipes and grievous injuries under Section 325 IPC each are attributed to them. Harbans Singh alias Bansa was stated to be armed with iron rod and simple injury under Section 323 IPC is attributed to him. Similarly, Gurdeep Singh alias Baggi was stated to be armed with iron rod and grievous injury, which falls under Section 325 IPC is attributed to him. Petitioners Baljit Singh alias Shanti, Gurdeep Singh alias Baggi, Harbans Singh alias Bansa have been in custody since 16.11.2015. Bagga Singh alias Bittu-petitioner has been in custody since 29.9.2015. The petitioners are not required for

Cr. Misc. Nos.M-17050 of 2016 etc.

[3] interrogation or investigation purposes as they are in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioners in custody till the final disposal of the case. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the cases, these criminal miscellaneous petitions are allowed and the petitioners are ordered to be released on bail subject to their furnishing personal bonds in the sum of `40,000/- each with one surety each in the like amount to the satisfaction of the trial Court/Duty Magistrate.
