(ORAL) The petitioner herein seeks the relief of regular bail in the criminal case pertaining to the FIR bearing No.45 dated 06.04.2018 registered at Police Station Jandiala, District Amritsar, under Sections 379-B (2), 427, 473 read with Section 34 IPC, with the allegations that he, alongwith his co-accused, snatched and took away the car belonging to complainant-Mandeep Singh.

Learned State counsel has submitted the custody certificate of the petitioner as well as the reply, filed on behalf of the respondent-State by way of the affidavit of Deputy Superintendent of Police, Jandiala, Amritsar Rural, in the Court and these documents are taken on the record. I have heard learned counsel for the petitioner as well as learned State counsel in this petition and have also perused the file thoroughly. Learned counsel for the petitioner submits that the petitioner is SEEMA SHARMA 2021.11.10 16:24 I attest to the accuracy of this order

behind the bars since the date of his arrest, i.e 21.04.2018 and his co-accused named Gurpreet Singh @ Gopi, Jagdeep Singh @ Jaggu and Jagroop Singh @ Roopa have already been granted the relief of regular bail by the Co-ordinate Bench vide the orders Annexures P-3 to P-5 and he contends that in these circumstances, the petitioner deserves the relief as prayed for in this petition.

Learned State counsel does not dispute the above-referred factual position but he opposes the prayer of the petitioner on the ground of the gravity of the offence as allegedly committed by him. Keeping in view the afore-discussed facts and circumstances as well as the facts that learned State counsel has apprised the Court that out of total 12 witnesses, only one witness has been examined before the trial Court and it being so, the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Wassan Singh @ Wassan is ordered to be released on regular bail subject to his furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
