HARINDER SINGH SIDHU, J By way of filing instant petition, the petitioners have prayed for quashing of complaint (P.1) pending before the court of learned JMIC, Pathankot, summoning order dated 12.06.2012/21.09.2009 and order dated 29.4.2017 (P.5) declaring the petitioners as proclaimed persons. At the very outset, learned counsel for the petitioners states that he may be permitted to withdraw the petition qua challenge to the complaint and summoning order with liberty to raise all the pleas before the learned trial Court.
Dismissed as withdrawn with the liberty aforesaid. Learned counsel states that petitioner Nos.2 & 3 are senior citizens and are suffering from various ailments. They are permanent residents of Darjeeling, which is about 2000 kms from Pathankot where the case is pending. It would be difficult for them to travel this far to attend the court proceedings especially in view of Covid-19 pandemic. CRM-M-13402-2021 #2# application before the learned trial Court for exemption from personal appearance and the trial Court would pass appropriate orders thereon in the light of facts and circumstances of this case. With regard to the challenge to the order declaring the petitioners as proclaimed offenders, on request of the learned counsel, he is permitted to withdraw the petition with liberty to file a fresh petition with better particulars.
