The learned counsel representing the appellant submits that despite his best efforts, the appellants in both the appeals could not be contacted, therefore, he is unable to inform the current status of the dispute. 2.

It has been noticed that originally, the appellant in Regular Second Appeal No. 1052 of 1994 filed a suit for the recovery of an amount of ₹83,398/- which was dismissed by the trial Court, however, decreed by DEEPAK KUMAR BHARDWAJ 2024.02.08 10:55 I attest to the accuracy and integrity of this document

2024:PHHC:016043 Regular Second Appeal No. 1052 of 1994 AND Regular Second Appeal No. 1312 of 1997 the First Appellate Court for the recovery of ₹61,000/- with proportionate costs throughout. It appears that the parties are not interested in prosecuting both the appeals.

Keeping in view the aforesaid facts, both the appeals are dismissed for non-prosecution with the liberty to revive the same if they feel aggrieved.
