IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CR-1550-2020 (O&M) Date of decision : 03.03.2020 M/s Mindlogicx Infotech Limited ... Petitioner
Versus
Punjab Technical University, Kapurthala and others ... Respondents
CORAM:
HON'BLE MRS. JUSTICE ALKA SARIN
Present:
Mr. Jasraj Singh, Advocate for the petitioner.
**** ALKA SARIN, J. (ORAL) The present revision petition has been filed for a direction to the Court below to expedite hearing of the application under Section 34 of the Arbitration Act as well as to decide the execution application filed for enforcement of the Arbitration Award dated 13.01.2017. Learned counsel for the petitioner contends that since 2017, both the execution application as well as the application under Section 34 of the Arbitration Act are pending and have not been decided. Learned counsel for the petitioner contends that the execution application should be decided prior in time inasmuch as there is no stay in the said matter.
The execution proceedings and the proceedings under Section 34 of the Arbitration Act were clubbed with the consent of the petitioner herein and hence, both the matters are now pending before the same Court. However, it appears that since 2017, not much progress has been made in the matter.
YOGESH SHARMA 2020.03.06 15:43 I attest to the accuracy and integrity of this document CR-1550-2020 (O&M) Since the prayer made is totally innocuous, hence, I do not deem it necessary to issue notice of motion and call upon the other side. In view of the facts of the present case, the present revision petition is disposed off with a request to the Court below to try and decide the application under Section 34 of the Arbitration Act as well as the execution application preferably within a period of two months from the date of receipt of the certified copy of this order.
