CRM-M-16151-2015 Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Meeta Singh, who has been booked for having committed the offence punishable under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985, in a case arising out of FIR No.112, dated 21.11.2013, registered at Police Station, Boha, District Mansa. Learned counsel contends that concededly the petitioner was not arrested from the spot from where the alleged approximately 70 kilograms of poppy husk was recovered from his co-accused Kala Singh. He further contends that the petitioner is neither required nor involved in any other case. He further contends that the petitioner is behind bars from 04.02.2015.
Learned counsel for the State has not controverted the factual aspects narrated by the learned counsel for the petitioner.
-3I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.
Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Meeta Singh son of Gajjan Singh @ Ganjan Singh, resident of village Mamarha, Tehsil Ratia, District Fatehabad, is ordered to be released on bail during pendency of the trial of the present case subject to his furnishing bond in the sum of `75,000/- (Rupees seventy five thousand only) with one surety in the like amount to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Mansa.
