***** ARCHANA PURI, J. (Oral) Respondent had made appearance before the Court today and submits that he does not intend to file reply. He has also produced on record the copy of his Aadhar Card, to affix his identity, copy whereof has been retained on the court file.
Learned counsel for the applicant, as well as respondent heard. The applicant/wife has filed the present application, for seeking transfer of the petition under Section 13 of Hindu Marriage Act, i.e. DMC/1302-2022 titled "Ravi Sharma v/s Hemlata Sharma @ Hema", filed by the respondent/husband, pending in the Family Court, Hisar, to the court of competent jurisdiction at Faridabad.
As evident from the contents of the application, no child was born from the wedlock of the parties to the lis. Even, no other litigation is pending between the parties. TA-294-2023 is working and the applicant/wife is residing at Faridabad at her parental place. But anyhow, the respondent has no objection, if the present transfer application is allowed and the divorce petition is transferred to Faridabad. Considering the submissions, so made by the respondent and also considering the fact about convenience of the wife to be taken into consideration, as per the settled law, without prejudice to the rights of the parties to be adjudicated on merits, the instant transfer application, as such, is hereby accepted and the petition under Section 13 of Hindu Marriage Act, i.e. DMC/1302-2022 titled "Ravi Sharma v/s Hemlata Sharma @ Hema",
stands transferred from the Family Court, Hisar to the Court of competent jurisdiction at Faridabad. The requisite record of the aforesaid divorce petition shall be transferred by the Family Court, Hisar to District and Sessions Judge, Faridabad. Learned District and Sessions Judge, Faridabad, shall assign the said petition to the Family Court, Faridabad. Even, the parties are directed to appear before the Family Court, Faridabad, within a period of one month from today onwards.
